PUA Backdate Request Denied
/When a request to backdate a PUA application is denied, appealing the most recent monetary determination will force the issue into the appeal process and ultimately a telephone hearing.
Backdate requests are often done over the phone. A person might be told that their request was denied, receive a notice telling them it was denied, or no response at all. At the same time, a person may receive several different determination notices. Non-monetary determinations address issues such as a person’s eligibility and whether they satisfied documentation requirements. Monetary determinations read as though the person is approved and establish their weekly benefit amounts.
To appeal the PUA’s decision not to backdate an application, appealing the most recent monetary determination can force the issue into the appeal process. At first, this may not seem to make sense because the monetary determination may read as though it is approving the person. However, the person would solely be challenging that start date of the benefits. To force the issue into the appeal process, an appeal must be tied to a Determination Notice, and the most appropriate Determination Notice is the most recent monetary determination. The are the instructions that the PUA has issued.
The person might explain that they are appealing the start date of the benefits, the date the benefits should be backdated to, and why. The PUA should answer this appeal with a Redetermination Notice. If the Redetermination also denies the backdate request, appealing that redetermination should trigger the case to be transferred to the Unemployment Compensation Review Commission, who will schedule a telephone hearing over the appeal.
